Please read these Terms and Conditions carefully before placing an order with us. By completing and submitting your order, you confirm that you have read, understood, and agree to be bound by these Terms and Conditions. These Terms do not affect your statutory rights.

1. Products & Availability

Products on this website are available for local delivery in Aberdeen, Scotland, UK, with select products also available for nationwide UK postal delivery. Certain products may be delivered in bud to ensure longer life.

Some flowers and plants may be harmful or poisonous to people or animals. If you require further information before placing an order, please contact us using the details in Section 6 below.

All products are subject to availability. In the event of any supply difficulties, we reserve the right to substitute a product of equivalent value and quality without notice. If we are unable to supply the product or any suitable substitute, we will notify you as soon as reasonably possible and refund your payment in full, and in any event no later than 14 days after the intended delivery date.

2. Prices & Payments

Prices are as displayed on the website at the time you place your order and include VAT where applicable.

When submitting your order, you will be required to provide accurate personal details including a correct postcode, along with the details of the intended recipient and your payment information. We accept payment by most major credit and debit cards, processed securely by Stripe.

By clicking the 'Complete Order' button, you agree to be bound by these Terms and Conditions. Your order is subject to our acceptance. We will not be bound by a contract until we have sent you an order confirmation by email.

3. Your Right to Cancel

As our products are fresh flowers and perishable goods, they are exempt from the 14-day cooling-off period that applies to most distance sales under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013. This means you do not have an automatic right to cancel once an order has been accepted.

However, you may request to amend or cancel your order up to 24 hours before the intended delivery date by contacting us using the details in Section 6 below. Where cancellation is accepted in time, we will refund your payment in full within 14 days.

You are entitled to cancel any payment at any time where fraudulent use has been made of your payment card by a person not acting on your behalf.

4. Delivery

We operate a two-tier delivery service: local delivery within the Aberdeen, Scotland area, and nationwide UK delivery via Royal Mail or other third-party couriers for select eligible products. On acceptance of your order, we will confirm the intended delivery date by email.

We do not deliver on Sundays or on certain public holidays. Orders requested for these days will be delivered on the next available working day. Please ensure you have provided the full address details and accurate postcode of the intended recipient, as errors may cause delays.

Local Aberdeen Deliveries: We deliver to the address provided. If no one is home, we may deliver to a neighbour. We do not require a physical signature for delivery. Proof of delivery is recorded by our drivers and may include a photograph of the item at the location or the name of the person who accepted it. Where goods have been correctly delivered, we cannot accept responsibility if the intended recipient has moved or refuses the item.

Deliveries to Funeral Directors and Third Parties: In the case of delivery to locations where a third party is involved (such as a funeral director, office, hospital, or hotel), delivery to the premises shall constitute a complete and successful handover, whether or not a specific individual signs for or acknowledges the item at the time of delivery. Handing the item to a member of staff, leaving it at reception, or placing it in a designated flower room are each accepted as completed delivery. Our responsibility ends at the point of handover to the premises. We accept no liability for items that are lost, misplaced, or damaged by a funeral director or any other third-party organisation after we have completed delivery.

Nationwide Postal Deliveries: For products dispatched via Royal Mail or other couriers, delivery dates are estimates provided by the courier. Whilst we dispatch items on time to meet your requested date, we cannot guarantee exact delivery dates or times and accept no liability for delays caused by the courier network.

Funeral Orders (Local Delivery only): Please use the Delivery Notes field to specify a preferred delivery time. Whilst every effort will be made to deliver prior to the requested time, no strict guarantee can be given.

5. Liability & Disclaimer

We accept liability for death or personal injury arising from our negligence, and for fraudulent misrepresentation. Nothing in these Terms affects your statutory rights in relation to the quality, fitness for purpose, or description of the products supplied.

Other than as stated above, our liability in contract, tort (including negligence), or otherwise arising in connection with your order shall be limited to three times the price you paid for the products concerned.

We exclude all liability for indirect or consequential losses, including loss of profits, arising directly or indirectly from your use of this website. We shall not be liable for any delay or failure to perform our obligations where such delay or failure is due to a cause beyond our reasonable control.

Because of the perishable nature of our products, we ask that any complaint is made within 1 working day of the delivery date so that we can investigate and resolve it promptly. This time limit does not affect your statutory rights under the Consumer Rights Act 2015.

If we are unable to resolve your complaint to your satisfaction, you may also seek assistance from your local Citizens Advice Bureau or Trading Standards service.

7. General & Data Protection

We reserve the right to update these Terms and Conditions from time to time. Any changes will apply to orders placed after the date on which the updated Terms are posted on this website.

We comply with all applicable data protection legislation, including the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018. Personal data collected as part of your order will be used only to fulfil and administer that order, and as described in our Privacy & Cookie Policy at https://www.aflorists.com/privacy-policy/.

Your purchase will be deemed to have occurred in the UK. These Terms and Conditions are governed by and construed in accordance with Scots Law, and the parties agree to submit to the exclusive jurisdiction of the Scottish courts.
